Liability Waiver & Release of Claims

Authorization to Perform Services

I, the undersigned ("Customer"), authorize Elysium Mobile Detailing ("Company") to perform automotive detailing services on the vehicle listed above, including but not limited to: washing, drying, vacuuming, interior cleaning, stain treatment, odor treatment, polishing, waxing/sealant application, trim treatment, and other related services requested by Customer.

Customer confirms they have authority to approve services for this vehicle.


Condition of Vehicle & Pre-Existing Damage

Customer understands that vehicles may have pre-existing damage or conditions that are not obvious until cleaning begins (including but not limited to: scratches, swirls, rock chips, cracked paint, failing clear coat, weak trim coatings, oxidized plastics, loose badges/trim, fragile interior panels, torn leather/vinyl, failing adhesives, aftermarket wraps/PPF, and tint issues).

Customer agrees the Company is not responsible for pre-existing damage or deterioration due to age, wear, prior repairs, improper prior cleaning, or manufacturer defects.


Assumption of Risk & Release of Liability

Customer understands detailing services may involve the use of chemicals, tools, steam, water, brushes, towels, extractors, and polishers which carry inherent risk (including the risk of revealing hidden defects or causing worsening of pre-existing conditions).

To the fullest extent permitted by law, Customer releases and holds harmless the Company, its owners, employees, and contractors from any and all claims, losses, or damages arising out of or related to:

  • pre-existing damage or defects,

  • normal wear-and-tear or fragile materials,

  • staining, discoloration, fading, cracking, peeling, delamination, or corrosion that occurs due to existing conditions,

  • malfunction of electronics or accessories that were previously compromised or exposed to moisture before service,

  • issues related to aftermarket parts (wraps/PPF/tint/paint correction history).


Electronics, Sensors, and Water Sensitivity

Customer acknowledges that modern vehicles contain sensitive electronics (buttons, screens, sensors, seat controls, airbags, amplifiers, wiring, etc.). Customer understands that while the Company uses reasonable care, the Company is not liable for failures related to pre-existing issues, aftermarket wiring, prior water intrusion, or defective seals.


If Customer requests services near sensitive components (e.g., headliners, pillars, dashboards, infotainment, gauge cluster, trunk/spare-tire wells, or seats with electronics), Customer accepts the additional risk.


Runoff, Landscaping, Surface Staining, and Overspray

Customer understands that mobile detailing involves water use and chemical application that may create runoff and/or overspray. While the Company takes reasonable precautions to minimize overspray and runoff (including controlled application, dilution, and post-rinse where appropriate), Customer acknowledges that some environments and surfaces are sensitive and may be affected. To the fullest extent permitted by law, Customer agrees the Company is not responsible for staining, spotting, discoloration, etching, fading, damage, or residue affecting surrounding areas, including but not limited to:

  • grass, lawns, plants, mulch, or landscaping,

  • concrete, asphalt, pavers, bricks, sealed or unsealed surfaces,

  • painted or coated driveways, and

  • drainage areas where runoff may collect.


Customer also acknowledges the possibility of overspray or mist contacting nearby property (including nearby vehicles). Customer agrees to provide a suitable work area and to relocate or protect nearby vehicles and items as needed (or allow the vehicle to be moved to a more suitable area) prior to service. If the work area is too restricted or conditions are likely to cause damage, the Company may pause/refuse service or require relocation/containment measures.


Personal Property

Customer agrees to remove valuables and personal items before service. The Company is not responsible for loss or damage to personal items left in the vehicle, including cash, electronics, documents, or other property.


Access, Keys, and Safe Working Conditions

Customer agrees to provide safe access to the vehicle, necessary keys or access codes (as applicable), and a safe working environment (reasonably free of hazards). Customer understands services may be paused or refused if working conditions are unsafe.


Satisfaction & Final Inspection

Customer agrees to inspect the vehicle upon completion (or within 2 hours of completion if the vehicle is not present). Any concerns must be reported within that time. After that window, the service is deemed accepted.


Payment, Keys, and Release of Vehicle

Customer agrees that payment is due upon completion of services unless otherwise agreed in writing. Customer understands and agrees that the Company may retain possession of any vehicle key(s) provided to the Company until payment is received and confirmed in full.


Customer further acknowledges that the vehicle will not be considered "released" back to Customer until payment is collected. If Customer is not present at completion, Customer agrees to submit payment promptly upon notification of completion, and the Company may withhold the key(s) until payment is received.


No Guarantee of Complete Removal

Customer understands some stains, odors, pet hair, scratches, etching, and defects may be permanent or may require multiple sessions or specialized restoration. The Company does not guarantee complete removal of all stains/odors/defects.


Limitation of Liability

To the fullest extent permitted by law, if the Company is found liable for any reason, the Company’s total liability shall not exceed the amount paid for the service performed on the date of the claim.


Governing Law

This waiver shall be governed by the laws of the state where the service is performed.


Photos & Documentation

Customer authorizes the Company to take before-and-after photos/video of the vehicle for documentation and quality control.


Acknowledgment & Signature

By signing below, Customer acknowledges they have read and understood this waiver, agree to its terms, and voluntarily sign it.


Electronic Signature (eSignature): By submitting this document electronically, you agree that your electronic signature (using a keypad, mouse, or similar method) is legally binding, just like a handwritten signature. No third-party verification is required, and the agreement is enforceable between you and Elysium Detailing.
